四、行政体制和行政机构 1．行政体制概述 (1)行政体制的含义和内容。行政体制是指国家行政机关的组织制度。在公共行政中发挥着重要的制度保障作用。一个国家的行政体制是否合理、健全，对公共行政的效果会产生深刻的影响。行政体制通常与国家的立法体制、司法体制相对应。行政体制包括广泛的内容，例如，政府组织机构、行政权力结构、行政区划体制、行政规范等，其核心是政府的机构设置、职权划分以及运行机制等。 1)政府组织机构是行政体制的载体。任何一种行政体制都必须建立在一定的组织形态之上。政府组织机构通常包括从中央到地方的纵向政府机构设置和各级政府内部的横向机构设置等多种类型。政府组织机构的设置是否科学合理，对行政体制的运转会产生重要影响。 2)行政权力结构是行政体制的核心组成部分，也是行政体制得以正常运转的动力。行政权力结构不仅规定行政权力的来源、行使的方向、方式等，而且还要规定行政机关与其他国家机关、政党组织以及群众团体之间的权力配置关系，其核心内容是国家行政机关在政治体制中所拥有的职权范围、权力地位以及行政机关内部各部门之间的职权划分等。一般来说，科学合理的行政权力结构配置，对行政体制的正常运转会产生积极的影响，反之，则会对行政体制产生负面影响。 3)行政区划体制是指国家为实现对社会公共事务的有效管理，将全国领土划分为若干层次的区域单位，并建立相应的各级各类行政机关实施管理的制度。行政区划在不同国家，或在同一国家的不同时期，划分为不同的类型和层次，例如，我国现行的省级行政区域、市级行政区域、地级行政区域、县级行政区域、乡级行政区域等。行政区划的划定要充分考虑其领土大小以及政治、经济、文化、民族、人口、国防、历史传统和地理环境等综合因素。一个国家的行政区划是否合理，也同样会对该国的行政体制产生重要影响。 4)行政规范是指建立在一定宪政基础之上的行政法律规范的总称，它是国家行政机关行使公共权力、实施公共事务管理的行为规则。任何行政活动都必须有相应的法律授权，所有国家行政机关行使的权力、各部门的职责权限等也必须通过一定法律加以限定。从这个意义上说，行政法律规范不仅影响行政体制的运行，而且也规定着各类行政机关行使行政职权的内容、范围和形式等。 (2)政治制度对行政体制的影响。行政体制是政治制度的重要组成部分。所谓政治制度，是指统治阶级为实现其阶级统治所确立的政权组织形式及其相关的制度。它是政治统治性质和政治统治形式的总和，也就是我们平常所说的国体与政体的统一。所谓国体，是指社会各阶级在国家中所处的地位。国体(即政治制度的性质)决定行政体制的性质。政体(即政治统治形式)影响着行政体制的组织形式。政治统治性质是根据国家的阶级属性来划分的；政治统治形式，是由国家的管理形式、国家的结构形式、政党制度、选举制度及社会团体与公民参政制度等一系列制度构成的。
